Compensation agreement

    Hi,
    Just wondering if anyone can help. I recently was injured as a result of a business owners actions with a dangerous liquid.

    He has agreed to compensate me for my injury by approach me directly in person, I feel I was scaremongered into accepting with tales of similar incidents in his profession being throwed out of court and with the cost I would incur to bring him to court and was put on the spot with his claims. I have not signed anything or received anything from the business owner as he is going to his solicitor to clear with him giving out this compensation.

    Can anyone give me any insight to what you think of the matter. Many thanks in advance.

    Hard to comment without knowing the details but it may well be worth seeking the advice of a Solicitor or talking to someone in the injuries board. Remember he has his own good at heart not yours. If he thought that the claim would be thrown out of court why would he not let it. If it was thrown out you would have to pay his costs so it wouldn't cost him anything. I have a feeling he is feeding you a story to scare you into agreeing.

    The quick and short answer is my ear was burned by been set alight by mylthlate spirits in a babers and was offered 100 euro. It Is a minor burn but should not of happened. No sign of infection, so fingers crossed don't have to go through that as well.

    Was there any doctors visits? Hospital bills?

    There was a doctor's visit, but was not charged because I have a medical card.

    In short, it is a good idea to settle directly if there is a proper offer being put forward as it saves trouble for everyone involved.

    This sounds like a well undervalued attempt to dispose of you on a nuisance value basis and that is as far as the charter allows me to go !!!

    You should take the benefit of at least one consultation with a solicitor for proper advice on quantum.

    BTW I do not see any issue on liability for the accident as setting your customers on fire tends to reverse the onus of proof on to the service provider I]res ipsa loquitur[/I.

    But did you have an injury...need cream? Medicine?

    He said that he suffered a minor burn. That is an injury.
