Brother cost me 2 extra points

    Can anyone shed some light on this for me? I got a speeding fine in the post back in July and my brother was going into town so I filled in my details and gave him the money to pay it for me and he said he would. I assumed he had taken care of it but received a summons for an unpaid fine and now have a court date for it! Am I guaranteed to get 5 points now? Is there any way to keep it to only 3 and pay the original fine? I went to the post office since to try pay but they wouldn't accept it.

    Would it be worth getting a lawyer for this? Also, assuming it's going to be a bigger fine than the €80 and a higher insurance premium, who should be paying for all the extra costs associated with not having paid the original fine do you all think as this is an argument waiting to happen between us now.

    I'm actually insured on his policy and he suggested we could say he was driving and they could reissue the fine to him and he could pay and would only get the 3 points but I said its way dodgy and probably too late at this stage to try.

    I'd be happy jus to take the 3 points and pay the 80eur, what chances are there of this being the outcome in court?

    What happened to the money you gave him? It's not entirely clear whether he never paid the fine, or paid it and there's some error in the system.

    Sorry OP but it's too late for remedial action now - if you gave your brother cash he owes you €80 but that's it really unless he's willing to help out with the extra costs you now face.

    The lesson here is never to trust anyone else to do stuff like this for you.

    Nice brother. If he is not a complete cnut, he will go to court with you and you can both explain to the judge what happened. Then hope for the best.

    Which I imagine won't change a thing, else you would get everybody just claiming similar every time a fine isn't paid in time.

    Fair point. I do reckon though a judge could distinguish between the truth (the shame on the face of the brother / the hurt on the face of the OP) and some BS story some other people would come up with.

    For sure a judge would have a lot of discretion in what he / she decides the verdict would be. This is what I would go for. Tell the truth and hope for the best.

    Have you / anyone else a better suggestion?

    For cases like this I would prefer the system to be black and white rather than relying on the judges poker skills, far too many professional chancers out there.

    My suggestion for the OP? Pay the fine and take heed of a good life lesson, there are things in life you need to make sure are sorted out yourself instead of relying on others.

    Remember the story of the model/beauty queen clocked doing humongous speed
    on the M18 in her mother's Mercedes? The judge ended up thanking HER!!

    Now, if only the OP's brother could somehow become his sister who in turn had been a model/beauty queen.

    But seriously Dispostableacc... unless your brother is a known scumbag, apart from any fines/points maybe you need to talk to him about what happend the money and why he couldn't tell you? Genuinely - does he have some problem that he needs help with?
