Bike stolen from work

    So my bike was stolen from the "secure" underground car park in work, and I was wondering if i have any recourse with them. I left the bike there overnight, as I was going to Belfast the following morning with work, and wanted to collect it after I got home. I know it's almost always a "leave stuff at your own risk" kind of situation, but there were two bikes stolen the week before mine, and no one in the company was informed about it. 8 bikes were then taken last Tuesday night. They got access through the flats next door, which apparently has access to the car park (something else we weren't aware of).

    Does the company not have a responsibility to tell it's employees when stuff is stolen from the car park? I absolutely would not have left the bike there overnight if I'd known about it.

    Long shot i know, but just wanted to see if I've any options here.

    I can't see how liability would attach myself but I'm open to correction.

    One would imagine that they have disclaimed any liability with the usual signs. Ultimately it is your Bike and you are responsible for it because you have control over how it is locked, whether is left over night etc. Bad luck, its an awful thing to have happen to you.

    Generally, I think that there is no duty of care owed to employees in respect of property lost or stolen at work.

    However, if employers were to offer a specific arrangement for safe custody of employee's property they might be considered as bailees. In that event the employer would have a duty to act reasonably for the protection of the property even at the lower level of responsibility of a gratuitous bailee ( as distinct from a bailee for reward).

    Check Ts & Cs of employment to see if there any provisions relating to property in your place of work.

    Otherwise, there is probably no liability on the employer.

    Talked to some of the brokers in here, and they all agree that the company doesn't have any liability, so we're just hoping the company can help us out with some of the costs. It looks bad on them that nothing was communicated about the theft, so hopefully they'll be decent about it and reimburse us at least some of the costs.

    Pain in the f*cking hole i'll tell you :mad:

    Yeah, footage of the guys who took the bikes is clear as day, but even if the Garda get them, the bikes will almost certainly be gone. Still waiting for an update from them though, so we'll see what happens.

    Yeah, was up there for some work for the day. It was stolen the night before though.

    And i'm planning on doing the bike to work scheme this time around. Hopefully work will compensate us with a few bob anyway, which will let me get a decent bike again.
