Help with something on a Propery Folio

    Hi All

    I hope someone might be able to help and I apologize if this isn't the correct forum. I wasn't sure if it should be in Accommodation and Property.

    The following is on the property folio of my family home and i'm just wondering what it means.

    13-FEB-1986 CHARGE FOR PRESENT AND FUTURE ADVANCES REPAYABLE WITH INTEREST
    UDT BANK LIMITED IS OWNER OF THIS CHARGE

    Is this a Judgement Mortgage or something else?

    Thanks for any help you can give.

    Look at page 6 opf www.landregistryservices.com/samples/ireland/eire_no_address.pdf mainly 3 and 3b, listed as "mortgage affecting this property". I'm sure others who know what they're talking about will be along shortly.

    Kayroo the mortgage is listed above this. It was with Dublin County Council and started in 1975 and was completed in 2006. The lines of the mortgage are crossed out and marked as complete.

    Well, it's definitely some sort of mortgage!

    Are you the owner? Are you the owner since 1975? What happened in 1986? Was the house re-mortgaged or used as security for a loan?

    At some point you got a mortgage from GE Capital Woodchester (UDT Bank) and they registered the charge.

    Or, possibly, a loan was sought and a condition of that loan was a charge over the property. In any event, you owe money to GE Capital and if you stop paying it back they have security on the house. Nothing unusual there.

    The house is my dads and i'm trying to get his affairs in order. He is not in the best of health(dementia). He isn't paying anything to GE Capital not in the last 5 years anyway as i've looked at his bank statements. Hopefully its something that has already paid off and it just hasn't been cleared from the folio.

    Would anyone have any idea how i could go about find out what this is. I've asked his brother but he doesn't know anything?

    Be careful here.
    If he owes money, acknowledging the debt may mean having to repay it.
    The statute of limitations applies after 12 years.

    Misconception on debts. If he has a monthly repayment that he misses then the statute resets every month in effect. You can't wait your way out of a debt like this.

    You're now dangerously close to seeking legal advice OP so if you feel this warrants it then I'd speak to a solicitor. The note on the folio is not unusual but it is prima facie proof that UDT Bank (now GE Capital Woodchester) are the owner of a charge. If that should be removed then positive steps need to be taken.
