Before i start asking the question i don't want any smart comments, Just straight up answers i'm looking for.

Right anyway, I'm being brought to court for having no power steering and abs, Now the psv officer said, My car is dangerous because of no power steering and abs even though the car drove fine with them for months, Had no issues that put my life in risk, Would this get struck out as the car in question is a 1999 bmw, I think abs wasn't mandatory till 2005 but i'm not 100% sure maybe somebody can clarify this for me

How did the guard know your ABS wasn't working?

When he was seizing the car he drove it and then said to say that car is too dangerous for the road after seeing what the brakes were like.. The gaurd is a right wanker and even some of the gaurds don't like him

What reason did he give for seizing the car?

I think it will be a case that if the car came as standard with abs and power steering then they must be working.

Was the car originally equipped with ABS and power steering?

If so - then it shouldn't really be driven without them.

Normally on cars without ABS there is brake force distribution unit which distributes most braking force to front wheels compared to rear wheels.
In cars which are equipped with ABS, there is no such thing, so normally ABS takes care of this.
If you disable ABS in car which was normally equipped with it, you are very likely to block your rear wheels with much less pressure on pedal then front wheels. This can easiely lead you to side skid, especially if you are braking on a bend.

With powersteering - same thing. Cars which were equipped with it, usually have higher train ratio, so would require much stronger force on steering wheel when power steering is disabled.

It's understandable that they assumed you are driving not-roadworthy vehicle.

I also quite often disable ABS when driving on snow, as it makes it easier for me, but indeed it can be assumed that car is not roadworthy without it.

I can't see you getting done for removed / non-working power steering if it passed the NCT.

No ABS is a totally different kettle of fish. It depends if it was broken or disabled on purpose. If it broke you can just say you didn't know it was and it's up to the NCT to make sure it is working...

If it did have abs and it wasn't working you should have had a warning light on the dash. The fact you don't may be a sign the previous owner messed with the car to make it look in better condition than it was.

I'd be checking the car all over once you get it back.

I can go have a look tomorrow at the car and check if there's a light coming on the dash

Wasn't this the same BMW that was seized for having no head lights and a welded differential?

I'd be getting on to the Garda ombudsman as you're clearly being harassed for no reason by gardai

Assuming you've actually driven this car I'd like to think you'd have notice a light on the dash the whole time by now.

Your insurer will spit the dummy when they hear about this I'd say.

Are you sure it wasn't the brake assistance and not the ABS that wasn't working, he wouldn't have got out of the car giving out about the brakes if the ABS wasn't working, it isn't the sort of thing you miss if you just take a short drive in it. I popped a vac brake hose off by accident leaning on it fixing something else, and when I drove it the car felt like an 80s VW, but it still stopped, just needed huge force put on the pedal, it isn't something i'd be driving around without TBH.

When I had an e36 i'm sure the power steering was belt driven, I had swapped the engine in it and don't remember there being a vac pipe going to the power steering. I'd bet your belt is either off, or you're out of fluid. I've driven cars for ages with broken power steering, but I don't draw attention on myself so nobody notices unless they're watching me parking
