Hi there, Have been separated 10 years and got a judicial separation 8 years ago. Now want to get a divorce and do it myself but in the templates I found it looks for a statement of means. Surely it's not necessary as everything has been sorted. So my question is; If there is already a legal separation in place do you…

Hi there,

Have been separated 10 years and got a judicial separation 8 years ago. Now want to get a divorce and do it myself but in the templates I found it looks for a statement of means. Surely it's not necessary as everything has been sorted. So my question is;

If there is already a legal separation in place do you still need to give another statement of means when applying for a divorce?

Any help pointing me in the right direction would be greatly appreciated.

Yes you need an affidavit of means. It would be very common for a divorce to practically mirror the JS however the court still has to be satisfied that proper provision has been made for the parties.
