Land registry fees and Reg. of mortgage in land reg

    Hello I am hoping someone could help here please.

    I have recently separated and have gotten mortgage to pay off existing mortgage and enough to purchase my expartners title of the house.

    in relation to Land registry fees and registering of mortgage with the land registry - from what I read here : file:///C:/Users/Administrator/Downloads/S.I.%20380%20of%202012.pdf

    I have gotten 140K money from bank and I thought that the land reg. fee would be based on this:
    Application for registration of a voluntary transfer €130 (as it was voluntary transfer between ex and myself).

    Instead I have gotten a fee of 600 to be paid for Land Reg. fees and a 175 fee for registration of mortgage with the Land registry.

    Which is right please.

    Voluntary transfer is for no consideration. If you got a mortgage to pay off your partner it's not voluntary so depending on the value it's probably the 600.

    I'm a trainee solicitor and find the land registry staff are particularly helpful and knowledgeable. Ring them or pop in and they'll certainly help

    Also the mortgage is 175.... I did one recently and while I'm not an expert on their fees registration of a mortgage was definitely 175

    Thanks for your message, I contacted the land registry offices today and they have said that it depends on what solicitor says in the deed of transfer. , my question now is why would my solicitor not request the change of title deeds as a voluntary transfer? Is there a way of avoiding the higher cost when yes I have taken out mortgage to buy out the ex share in the property.

    because it wasnt a voluntary transfer. you bought out his share.

    And revenue will need to be informed of the value of the transfer.

    Your solicitor has to do it the right way. They won't lie and risk their own livelihood to save you a few 100s. And even if they did, you should run a mile
    From a solicitor who would do that.

    I was surprised myself when I copped a first registration is 130 but a transfer with mortgage and folio came to nearly a grand. I think the low fees for first reg are to encourage registration when it's not compulsory.
