Neighbour Needs Access for Maintenance Works

    The owner of a property neighbouring my parents property has approached and asked for permission to use my parents garden to access his roof to complete some essential maintenance works. Essentially, he wants to put some scaffolding up with footings in my parents garden so that roof works can be completed. He is a professional landlord and the property is full of lettings. We've never had any issues or any dealings with him. He seems reasonable and conscientious fwiw.

    I told him I had no problem in principle and to put the proposed works and access in writing to me. I said I would need to see the insurance cert of his contractor and that I specifically did not want the roof of my parents accessed in any way. (I don't want to have to examine it to see that there has been no damage caused).

    Before I give him the final OK, is there anything else I should consider putting in writing to him? What should I be getting him to commit to / warrant?

    You can ask for him to contribute towards the reasonable cost of you appointing your own architect or surveyor or engineer for overseeing your interest in this. And have him - the landord - provide a photo survey of the condition of your property before the works start and an underatking that all damages caused to your property accidentally or otherwise arising from his works will be repaired at his expense.

    After that - be reasonable yourself ( as you seem to be minded anyway)

    Cheers for that. There's a fair bit to digest there but very useful to know. However, I don't think I'll quote it to my own neighbour the next time I need to cut the bushes. Thanks again.

    Being a profesional landlord - the neighbour in the case of your parents place - you will not need to quoute anything to him - he will be well aware of the 2009 Act.
