Contract for renovation work

    Hi there

    Just wondering if I can get some advice please.
    I've bought an old cottage that needs renovating. Mortgage sorted and builder picked. I've got a sample contract to work from. If the builder overruns on time in doing the job what are the sanctions usually on this? I'm not up to a week or 2 extra to complete the job but not going to be settling for months extra?

    In contract penalties like this are called damages.
    Damages to be enforeceable must be demonstarble loss to the employer (you).
    So weekly damages can equal the weekly cost of rent you are paying whilst waiting to move in.
    If the contractor can demonstrate evidence that you are living rent free with relatives a judge may not impose damages.

    Experienced contarctors will find ways to seek in contract an extension of time. If they can demonstarte that you caused them to be on site longer then anticipated at the start of works then the contarctor can claim extra payments. You did not pick windows/kitchen/floor tiles in a timely manner for example.

    So a contract is always a good idea it does not gauarentee a good build just a structure to what happens if there is not a good build.

    Best to seek a time scheduled programe of works to include long deivery items like windows included. Then meet formally every 2 weeks and record in writing how the build is going including recording what the builder says he needs from you to keep works on programe. This tends to avoid delays or gives everyone a fighting chance of coping with delays.

    In parctice in my experience of domestic works programes do overun a little. 3-4 weeks in 40 avarage I would guess. Most clients do not seek damages and most contarctors do not seek extension of time.
