How to lodge a Commencement Notice and Opt Out under SI365 of 2015

    This may help some.
    How to submit a Commencement Notice under S.I. 365 of 2015.

    Due to the fact that the BCMS system has not been updated to take account of the new S.I. the following shall be the procedure in the interim period if you wish to make an “opt-out” Commencement Notice submission:
    The creator starts a "Short Form" (or “Commencement Notice without Documentation”) on the online BCMS.
     In the Description Field write “Opt Out – Construction of…etc” – this will identify it as an “Opt-out” application until the BCMS system has been updated.
    Complete the “online assessment” on the BCMS of the proposed approach to compliance with the requirements of the Second Schedule to the Building Regulations.
    The owner, builder and designer all accept their roles on the BCMS.
    The Commencement Notice form is downloaded and the owner checks that all the sections are completed and signs it.
    The Declaration of Intent to Opt Out of Statutory Certification document is downloaded and the owner checks that all the sections are completed and signs it.
    The Assignment of Builder form is downloaded and the owner checks that that all the sections are completed and signs it.
    The Commencement Notice form is uploaded as “Commencement Notice”.
    The General Arrangement Drawings (including plans, sections, elevations and any other relevant drawings) are uploaded. They should be put in as “Supporting Docs”.
    The Declaration of Intent to Opt Out of Statutory Certification document is uploaded as a “Supporting Doc”.
    The Assignment of Builder form is uploaded as a “Supporting Doc”.
    The creator then pays the fee online, and submits the Notice via the BCMS.

    Note: The creator should download the Commencement Notice form, Declaration of Intent to Opt Out of Statutory Certification and Assignment of Builder form from the BCMS, but if there are any technical problems in doing so, it is acceptable to print out the templates provided in the Building Control Regulations instead and to complete and upload them.

    At the self build trade show last weekend John Corless gave a talk on this issue and he said that the new commencement notice (which incidentally the Self Build magazine stall were willing to commit to a date on: their flier said it would be online on 30th Sept) on the BCMS would not include having to name the Builder. He was saying that previous to Bcar you didn't have to name the builder and it's going to go back to that now in the new commencement notice. However in the interim measure you've described here, the Builder does have to be named

    The builder can be the home owner.

    I wouldn't expect an update to the BCMS until at least 2 weeks.
    DCC will be trialling the new module soon enough as we are the biggest LA.

    If so he would be the rare exception.

    This issue has been charecterised throughout for years by clarity and certainty.

    Well I'll tell you from direct inside experience.
    If there's a builder appointed, he has to be named.if it's a self build, you can nominate the home owner.

    That's the way DCC Will be accepting them.
