Statute of limitations in medical?

    Asking this for a family member.

    She had to have an operation on a collapsed disk two years ago, she was supposed to have prosthetic disks placed. During the surgery the decision was made to place pins in the spine which resulted in considerable pain.

    She had to get an X-ray to try to find out if the pins were the cause of the problem & despite her protests that she couldn't move to position herself on the table, the radiologist insisted that she did without assistance other wise she would not be taking the images.

    This resulted in the person causing further damage which resulted in a further operation to redo the pins (some of them had broken part of the spine).

    Two years down the line she's still in a lot of pain (ends up crying a couple of times a week with it). I keep telling her to consult a solicitor but she's of the age that thinks "put up & shut up".

    Is there a statute of limitations on her taking action against the hospital for the radiologists actions & the surgeon for not ensuring her spine was solid enough to take the pins in the first place ?

    2 years from the date of knowledge generally- consult a solicitor

    Would that be from the operation or from the first time she reported still being in pain (about a month after) from it?

    This sounds like a serious injury. You need a solicitor to give proper advice. He may suggest consultation with counsel or advice from counsel, after taking up the relevant records. Time is a major issue.

    This cannot be dealt with here.
