Starting with same employer after redundancy

    I was made redundant two weeks ago, once my maternity leave came to an end. I received my redundancy pay, but did not get a p45. The company are Australian and arent always aware of the Irish taxation specifics, so that doesn't surprise me.

    However, the company have now asked me to come back on a contract basis (for a different department) and have sent me a contract to sign. As I haven't had the p45, I can't see how the revenue would know that my redundancy payment was actual redundancy and tax free, and not simply a bonus and taxable. Even the revenue office seem unsure on this, I'm waiting to hear back from them.

    I don't want to have a hefty bill when I balance my taxes at the end of the year, but with being on maternity leave, and with hubby starting a new job, I will need a p21.

    Should I ask for my p45 before signing the new contract?

    It is highly likely that the revenue will not see this as redundancy - your role has not been made redundant if they are bringing you back to do the same thing. Be careful or you could end up with a big tax bill. if you didn't want to have your terms and conditions changed then you have a very good case for unfair dismissal.

    Thanks Alan. It's not the same role, it is with a different department doing completely different work.
