Motor insurance claim against a 3rd party

    Hi I made a claim against a 3rd party that scraped the side of my car and drove off there was a witness and I called the guards that got in contact with him and u got his details to claim I got a quote and an acessor came out to have a look a nd agreed with my garage on an amount haven't heard a word from them since then I called 3 times and theysay they will call back but they don't so today I called and was told they wait for me to go and get it fixed and present a receipt and they will pay the garage or me if a paid already question can I ask for the money to be paid I to my account as I'm really buzzy and then going good o holiday in 3 weeks time and them I'm starting a new job in Kildare and won't have time for ages then to leve my car In what is my rights ?

    Why are you dealing with the other driver directly? Get your insurance to deal with their insurance, that's what you pay your premium for.

    I will a lot of people told me that's the way to do it don't get ur insurance involved

    If you only have third party then there's nothing your own insurance company can do for you. What you need to do is to get in touch with the other's guy insurance company and ask them to sort it out. You have a legitimate claim against their policyholder and ultimately they will have to pay you if he doesn't.

    But before it comes to that, you could simply threaten the other guy that if he doesn't come up with the cash that you are going to lodge a claim direct with his insurance company, that should get him moving.

    Hey guys, Im new to Boards, I wanted to come on as I need to ask a question, I find myself in a messy situation.

    1 month ago my car broke down in Dublin 2. I have 3rd party insurance with roadside assistance so proceeded to call them, they sent someone out who immediately diagnosed the problem as being battery related. I needed a new one but he would jump it, no issues. My electronic hand brake was also disabled, I let him know this (it wouldn't turn back on due to battery being dead).

    Now the strange bit, he proceeded to jump the battery with a portable power generator, as it charged he stood with one foot resting on bumper of car and stood right in the middle of the bumper of the car. He asked me to hop in and start the car, I did, I half sat in, started the car, the car jerked forward for some reason and he claimed the car banged off his knee (of the leg he had been resting on the bumper). I asked was he ok, fine, we went our spate ways. 2 hours later, he called me to let me know he was "not feeling great and was going home and needed to let me know this). I said fine, went about my day.

    2 hours after that, I got a call from my insurer saying he now wants to claim against my insurance for this?? Can he do this? I have been trying to ignore their calls from my insurer but need to act on it now. any advice wold be very much appreciated!!

    Whatever you do, don't ignore your own insurer. If you don't assist them in defending your position against the 3rd party, they'll end up with no option but to just accept whatever his version of events is. You need to help them help you and leave them to it after that

    ok...this accident involved personal injury. I'd suggest you contact your insurer asap and tell them whats happened.

    Whatever you do, don't get it fixed and look for money. He'll refuse to pay and you have a messy situation. Through the insurance, only way to go. You don't owe this hit and run merchant anything.

    Well you didn't run him over that's for sure! He got injured doing his job which was to get your car going on the roadside. Would have thought an injury like this would be against his own insurance or else directly against the insurance company which used his services. Can't see how this would be a claim against you?

    Injured repairing a car; that's down to his own professional indemnity insurance (or that of his employer). The most critical part here is that you started the car under his instruction, while he was mid-repair.
