Collision > Insurance > No NCT > Car Written off?

    if blue car hits red car and blue car is at fault 100% but the red car has no nct and is not worth much and without NCT could have a book value of say 500eur when the repairs are going to cost 1000eur, is it still possible to claim through blue car drivers insurance or would they just not pay out as it's a write off?

    Is there any risk of going through the claim with NCT out or would it be best to get red car passed the NCT first, or does it matter at all?

    Assume average market value for red car is 1000 euro if NCTed and 500 euro if not NCTed.
    If damage is for 1000, and red car has no NCT, then it will be a write off and insurer will pay out €500 and take the wreck.

    If push comes to shove and the red insurer starts looking at details they will probably find that at the date of collision blue NCT was up.
    Then it depends on the circumstance of the collision, could the state of the blue car have contributed to the collision.
    Without better details it's hard to say.

    It's the red car that has no nct.

    if the person was hit and the other 100% at fault and doesnt object or deny it you dont need tax nct or insurance on ur car for insurance for the party at fault to pay out.

    If it has no NCT it will devalue the claim as the person who looks at your car will look up similar cars on DD or adverts and get a market value - having no nct , the other parties insurance will try to pay you off as quickly as they can, take what they give you.

    had a friend with no insurance, no tax, no nct and car was rode off , insurance give 4 times what the car was worth + mobile and ipad breakages with no problems and sorted in a week!!!! :D

    Whether or not a car is taxed/NCT'd etc matters not if the accident circumstances are clear.

    The legality of the car are a matter for the Garda and a complaint should be made so that they look into it (if you wish).

    As for the Insurance company, they will pay out based on the pre-accident condition and adjust for all the missing 'optional extras' such as NCT & Insurance.

    if it was me I would take a bit more off too, good luck standing before a Judge looking for your full damages from an insured driver when you could not be bothered to buy insurance for your own car!

    This is completely flawed logic.
    Imagine you are trasspassing through someone's field, and owner comes down and shoots you with a shotgun. Is it his fault, or yours - because you shouldn't be there in a first place?

    I never said it did just good luck taking it to a Judge and expecting to get sympathy or a decent settlement.

    the insurance does not look for any details at all , they send their person out to value the car damage and if its a right off or its not worth they pay. they dont contact your insurance- NCT Only applys to the value of the car, if the car is NCTd its worth more if not its not. Believe me i seen this first hand not a few months ago !!!!!!

    If the gards are involved all they look for is insurance policy number off u if they fill in an incident report, they will ask if it was tax and NCTd , dont lie tell them no as it will be worse if u lie.

    In this co try and the UK it will depend on why you were trespassing; if for the purpose of crime then most likely the homeowner will not be prosecuted.
