Derelict Sites Act

    My local authority says that its Derelict Sites Unit doesn't consider a particular building in my area to be a derelict site at present as it is 'secured and maintained'.

    There is no roof on this building as it blew off in a storm about 18 months ago.

    Citizens Information gives this info:

    The Derelict Sites Act defines a derelict site as any land that “detracts, or is likely to detract, to a material degree from the amenity, character or appearance of land in the neighbourhood of the land in question because of”:

    Structures which are in a ruinous, derelict or dangerous condition, or
    The neglected, unsightly or objectionable condition of the land or of structures on it, or
    The presence, deposit or collection of litter, rubbish, debris or waste


    Here is a pic of the building. How can it not be a derelict site under this definition?

    Its clean, safe and secured. I presume thats what the council are looking at.

    I just don't see how it doesn't come under the Act.

    Yep, the site is bang in the heart of Limerick City Centre, in plain view of a few hundred commercial and residential properties.

    It is much nearer the buildings on it's side of the river, but you can't see them in the pic. I've attached a map.
