PAYE worker invoicing for freelance work

    Hello,

    I'm hoping someone can advise. I recently did some freelance work and the company requested I invoice them. They said unless I provided a tax clearance cert or other proof I could be treated as self-employed, they would deduct emergency tax. Prior to taking this job on, I had been a PAYE employee, taxed at the 20% band. The freelance work I undertook was for 3,000.

    From the research I have done, I think I should register as self-employed and hold off sending in the invoice until I get my tax clearance cert. I know this will mean I have to file taxes at the end of the year.

    The alternative is to be emergency taxed but I'm afraid it will take months to chase this up.Can anyone help?

    A catch 22 situation, but, you may be required to make a Tax Return submission in order to get a Tax Clearance Cert. (for the year previous, so Revenue can be certain that your tax affairs are in order)

    If the income is under 3174, you are not obliged to be registered as self assessed or self employed, and the income can be input through PAYE (your tax credits would be reduced to account for the income, and you'd pay extra tax through your employment)

    If you were doing freelance and you invoice them then that is proof of being self employed, surely?

    I mean an employee doesn't have to invoice for their pay.
    Ask them for their policy on holiday pay. If they consider you not self employed, then you were an employee and they'd have to pay holiday pay, and provide you with payslips and a pay employers prsi.
