well driving alone on learner permit is against the law, and you are not insured to do so. Therefore you are driving without insurance. Not sure what the penalty is but you would be ****ed to put it lightly

I'm fairly certain it's three penalty points for a first offence?

Ah 2 penalty points and a fixed charge of €80.

Isn't there a fine of up to €1000 as well as the two points? Your insurance won't automatically be invalid, so there's no penalty for driving without insurance, but in the event of an accident that pays out to a third party the insurer might be able to sue you to get the money back.
