Public Surface Water Sewer on our Property

    Hi,

    A year ago we purchased a house. A major reason for this purchase was that the house had a nice side garden that was ideal to put an extension on.

    6 weeks ago we submitted a planning application to Fingal County Council to put a two storey extension on to the side of our house.

    We have just been informed that there is a 300mm diameter public surface water sewer on our property and that a minimum clear distance of 3m must be maintained between this sewer and any part of the structure, including foundations. This in effect means that we cannot build anything in our garden!

    Has anybody else come across this?

    Is there any way around it?

    I did once work on a house in North Dublin area, where the home owners were building a new house in there side garden at the end of a housing estate.

    There was an existing foul drainage pipe which was servicing the houses in the estate which was running through their garden where the house was to be built.

    They had to get a contractor to 're direct a new foul drainage main into the road/footpath outside and connect into an existing foul manhole in the road. This meant that the section of foul drainage main running through their garden could be abandoned and they could go ahead with building.

    That could be what you would be required to do here.

    Is there a wayleave in place on the pipe?
    If yes, then this should have been picked up when you were buying the property. I'd be having a chat with your solicitor about why it wasn't mentioned.
    If no, then ask the council to remove it.
