The Amount of Maintenance

    Hi guys,
    There is a following situation. Couple separated in February, they have two kids which stayed with their mam. The wife demanding 800 euros per month as a maintenance. Husband earns around 600 per week. She is not working. They owe property from which husband was kicked out and pays his mortgage directly from his account.
    They didn’t settle any maintenance yet, he just paid couple months 800 per month but now can only afford around 400.
    The question is how to decide what amount to pay before court order or any agreement followed by mediation?

    Both mother and father need to make out an honest and realistic statement of their income and outgoings and look at how it can be divided equitably to provide for everyone in as fair a manner as is possible. As two households need to be provided for everyone has to accept that they will have a lower standard of living.

    There are a lot of variables. How much time do the children spend with their father, days, overnights ? How much is the mortgage oln the family home and how much is he contributing to it? Is this included in the 800 or is the 800 in addition to his mortgage payments? How much is his current accommodation costing him?

    There is no hard and fast figure it all depends on individual circumstances. What is reasonable until agreed by mediation or ordered by the court is what he can reasonably afford.
