Debit card fraud - will money be refunded?

    My friend's debit card has been used to clean out her entire bank account a few days ago. She left her purse in the canteen at work but realised pretty quickly and it had been handed in, cards intact but a couple of hours later her bank account had been wiped out, over 3000 euro, on various transactions such as a Spotify account, Betfair, online shopping, etc. She reported it to the bank (Bank of Ireland) and to the guards. The guards didn't seem too confident she'd get her money back though from the bank and said that the bank wouldn't share any details with them that might help them trace the culprit. The bank won't even speak to her, they say they can't while an investigation is ongoing. As you can imagine she's pretty upset by the whole thing and has mortgage payment due next week. Has anyone any experience of this happening? I would've presumed that she would get her money back from the bank but their lack of communication isn't helping reassure anyone.

    Generally, if she wasn't found to be negligent (such as having the PIN written down somewhere) and it was fraud, refunds happen: but no one can guarantee that here.

    The Gardai can request information from the bank, if they wish to investigate so that part is nonsense. The simple fact is, they don't tend to bother on "low-value" cases, or where they feel there is little chance of actually tracing it (Remember, they'd then have to send similar data protection requests to each of the merchants to find delivery/registration/billing addresses and names given etc).

    As for the bank: the reps won't have any information until their investigation is completed and they decide to refund or not. Such things are handled centrally, not at branch level and not in their call centres.

    Thought I'd update in case other people end up in similar situation. Money was gradually refunded over the space of a few days.

    Gardai say their hands are tied as the bank won't hand over information to them regarding what purchases were made, etc.

    There were 25 transactions in total in the space of under 2 hours, some almost simultaneously so there was obviously a team working at cleaning it out as quickly as possible. Lesson learned to us all, if your card is out of your posession even a few minutes, cancel it!
