    Hey all,

    I have a query for you all. I have been made permanent in my role in April on 12 months probation. Prior to this I was on fixed term contracts, seconded into my role from a 3rd party. My job / role has not changed, only the terms, and the ultimate employer.

    My query is, is there any way around the probation, given I have worked within my role for over 3 years? It only becomes an issue to be honest when I look for a mortgage. I have discussed the issue with management, but they are unsure how to proceed.

    Backdating the start date should have been discussed when you were being offered the permanent job - some companies will do this, but lots won't raise it as an option when you ask.

    However, they could write you a letter now, saying that despite what your contract says they have assessed your performance and decided that your probation period has been ended early. This is irrespective of whether you worked there before. The law says that probation is a maximum of 12 months, there is no minimum. The only downside for them is that you have greater protection from dismissal after your probation ends.

    many thanks for this. I would assume that having worked here over 3 years, and being made permanent that my performance has been at a minimum satisfactory. So this could be an option.
