Land never transferred to offspring etc

    Hi All,

    I am looking for some advice & here's the story:

    My mothers original homestead was never transferred from her grandfather to her parents name and so on. He passed away approx 1940.The only direct relatives left are her & another sibling which would be the grand children.I am wondering if anyone has had similar experience with this as I don't want to delve into it if its going to cost a fortune in legal fees as it may be quite complex.

    Realistically, you should approach a solicitor if you want to resolve this problem.

    I know of a similar matter which was dealt with under the s.49 process in the Land Registry, where possession of the property could be traced right back to the registered owner. There were many queries to be dealt with from the land registry, it took a long time and it was reasonably expensive.

    We have had something similar to this happen in our family whereby intestacy and procrastination and so on has made for a bit of a mess with regards transferal and registering the legal ownership of land. You will realistically need the aid of a solicitor with experience in land matters to get it sorted out as it can be quite time consuming and messy yet it is essential to do.

    One piece of advice I will give you is this; do out a little family tree and get as many death certificates of deceased family members as it will make things a lot easier for you and the solicitor from the get go.
