Apartment Incorrect Sizing

    The apartment I'm in the process of buying has a discrepancy on its area.
    The BER states that the apartment is ~ 9M squared smaller than the estate agent brochure. This would place the apartment well below the minimum size standard of 65M2. Even the brocure listed size is under 65M2. The apartment was built in 2008. I've notified the estate agent, my solicitor and the BER assessor and none of them seem to be phased by it. I'm not impressed and will be re-measuring the apartment personally tomorrow. Anyone ever heard of this type of situation before?

    Presuming you have a surveyor/engineer/architect surveying the property, ask them to check it. It should also be compared against the approved planning drawings as a significant reduction in floor area like that may have planning consequences

    The surveyor brought it to my attention. He only measure a couple of rooms on the survey, which matched the brochure. I'm left a voice mail for the Kildare planning office earlier, still no response.

    Ask your surveyor their opinion on the situation. Is it a one bedroom apartment? Department of environment guidelines suggest minimum 45m2 for a one bed and 73m2 for two bed apartments. It's possible your local authority has huger standards. If the apartments as designed were just meeting minimum standards and they were built significantly smaller, there could be serious planning consequences

    To be honest, the BER is the least of your worries. I'd be more concerned about the planning

    I got the plans and triple checked the measurements. According to the plan the apartment is only 49.07M². This includes the hallway.
