Loss of NCB

    Hi All,

    I just wanted some advice.

    I just got my renewal for car insurance with Allianz and i was quite shocked.

    Last december i was driving around a corner in dublin and a women banged into me about 10kph

    She sent me over an invoice fro damage with i argued with that was noted at about €210. i said i was not liable yet she pursued.

    long story shot i was adamant i was in the right. She felt the same way and pursued a claim off me, I got a call from allianz and then told them my side of the story. they said they would look into this and then that was the last i heard of it.

    nearly 8 months later now my renewal is up for and it shows loss of NCB.

    On the NCB is shows a sum for a claim over 10 times higher then the amount the other driver presented to me on an invoice.

    I am shocked allianz didn't even contact me regarding this and would just pay.

    is there anything in this area i can do?

    I had similar in the past. In my case, I didn't accept liability - nor did the other party.

    They attempted to claim for injuries and the Guards got involved. The Guards evantually dropped their case (I wasn't even in the area at the time the other party claimed I left the scene of the accident and the nearby CCTV satisfied the Guards that I was being honest).

    My insurance company agreed that I would get my NCB back if the other party sent an official solicitors letter confirming that they were not taking it any further - as if the other party was ever going to do that.

    The claim remained open for the full three years during which the other party had a legal right to claim for personal injuries before dropping off my file.

    In the meantime I had lost my NCB, regardless of the fact that there was no claims. This is because I couldn't afford the renewal quotes offered with the open claim against me and had to cancel my insurance - causing my NCB to expire after 2 years.

    Insurance can be very unfair at times.

    Complain.

    You're entitled to be kept fully informed by your insurer of how the claim is going.

    Also does something not sound a bit odd when it goes from roughly a 200 euro to nearly a 4k payout?

    Depends on the variables involved.

    Perhaps her neck got stiff.

    Maybe there was further damager discovered when they went to repair the vehicle.

    The car was only worth about 2/3k max.

    Photos show nearly un noticable damage.

    Speed was less then 10kph.
    likely 5/6kph.


    With a quote from enxpensive dealer to just respray the bumber its odd it go to that amount. Hence why i am thinking it is dodgy.

    So after i gave my feed back verbally should the insurer in this case allianz not have notifed me of the actions being taken to allow me to provide evidence to dispute?

    Whether or not you feel that the claim was warranted isn't really your call. Your insurer reserve the right to deal with claims as they see fit in your name. It's covered in your policy.

    Is your gripe not being informed or the fact that they did it ?

    The only real right of passage that you've got here is a breach of the Consumer Protection Code by the Insurer in not notifying you of the progress and closure of the claim (if that is the case)

    Best you can hope for is probably a reinstated No Claims Bonus but I imagine the claim will still fall under your name.

    This article mentions the claimant. Does this cover me as in my case a claim was made against my policy?

    Yes. Your insurance policy indemnifies you for claims made against you. In other words, you are claiming funds from your insurer to meet your obligations to a 3rd party.

    The practical way this operates is that the payment bypasses you and is given directly to the 3rd party but YOU are claiming.
