using my image without my consent

    I have just found out that a vendor i used previously has been using my image for commercial purposes and gain without my consent, they use my image on promotional material, i was completely shocked and appalled, has anyone any idea what I can do here?

    Ask them nicely to stop using it, in writing, and if they don't then you can engage a professional for legal advice if you wish to take it further.

    Thanks for the advice but I am furious that they thought they could just use my image for financial gain without my consent, what really bugs me is the fact that anyone could have seen my image

    You're not providing us with a lot of details but I'm guessing that it's a photography or print place and you previously used them to get pictures printed (perhaps on to a mug or some such) and they are now using your images for in-store promotion of their printing services?

    I would rather not say what the business is but yes you are not far off here, essentially a printing co.

    Did you submit your photo online? Did you read their terms and conditions? Is there anything in their terms and conditions that would permit them to use your likeness?

    It was my photograph which i gave the vendor and i submitted it directly to them so there were no terms and conditions etc

    If you took the photograph then copyright rests with you. I'd get onto them pronto

    Whats wrong with people seeing your image .

    Are you furious that these people are making financial gain from the flyer with your image and you are gaining nothing ?

    maybe your a bit stupid, why would i want people using my image for their gain? i have a right to my own privacy and i dont appreciate my image being bandied around for all to see, if you dont have anything construction to say, p*ss off

    Have you contacted the business in question to make a complaint about your image being used? If so what did they say.

    Unless the OP gave copyright way when they submitted to the "Vendor"

    With some services, when you submit an image (for print or use), you grant them license to use the image for promotion, while you retain copyright. It all depends on the terms and conditions.

    The OP really needs to talk to the business using the image and see what the story is.

    I'll take a shot in the dark here and say, if they gave you some money for your troubles you would take take their hand off!!

    You would have no problem then, your problem is financial.

    As far as I know, when you sent something using whatsapp, whatsapp owns your picture

    Actually.. back in 2012/2013 they did but ofc I need to look into finding the link, will take a day.
    They did a research about it.

    My point was regardless of whether WhatsApp did (and thanks PaulW for supplying the T&Cs) I don't agree the recipient of that message would own the content.

    Perhaps I misread the situation, but it doesn't sound like that WhatsApp situation is what the OP is describing?

    My read is that the OP used a printer or print service to get something done, and later found them using his image as promotion material.

    The OP needs to give proper details for people to know the situation. And the OP needs to talk to the firm involved and see what the situation is. Maybe they have themselves covered in their terms and conditions for use of their service, to license the image for promotion?? We don't know for sure, without details.
