Disability Allowance The appeal is allowed

    Hi All.
    Some days ago I received a letter from the Social Welfare Appeals Office.
    They wrote:

    "The appeal is allowed"

    and:

    "Disability Allowanece must be paid where a person is substantially restricted in undertaking work Which would otherwise be a Suitable with reference Their age, experience and qualifications, and the specified disability must have continued for or be expected to continue for at least one year.
    Having Examined carefully all the evidence in this case, and taking account of the medical evidence available, I have Concluded That the appellant has established That the meets the qualifying medical conditions. In the Circumstances, the appeal is allowed. "

    So, whether it is a confirmation that the allowance is granted? If so, when I get the first check?

    I would be very grateful for your help.

    I would reckon it might take a couple of weeks but it will be back dated to when you first applied.

    Just wondering how long after you were allowed your appeal did you receive a payment? I'm in a similar situation and have been waiting just over a year to be allowed my appeal and I'm anxious to find out when I will receive a payment ?

    Can any of you guys help me out?

    Just wondering how long after you were allowed your appeal did you receive a payment? I'm in a similar situation and have been waiting just over a year to be allowed my appeal and I'm anxious to find out when I will receive a payment ?

    Hi Adam161,

    Based on what you have listed it would appear that the Appeals Office have allowed/approved your appeal.

    This means that Social Welfare should:

    - backdate your date of approval to the original date of application, and
    - backdate any payment of Disability Allowance to the date of original application.

    As such, this period is now reconcilable for access to training and education options as a person on a Disability Allowance payment.

    HOWEVER....

    In as much as you had the right of appeal, SW can seek to appeal the decision of the Appeals Office in granting your DA claim. It does not happen that often, but it can. You would be advised of this.

    If you have been paid an SWA payment pending the outcome of the appeal, the SWA payment will be deducted from any DA arrears accrued during the appeal period.

    If you have been receiving any SWA payment pending the outcome of the appeal, that payment will stop on the basis you are now on DA.

    If there is any undue delay in receiving your DA payment, and you are unable to get a satisfactory answer from SW you can:

    - bring this matter to the attention of the Appeals Office,
    - make a formal complaint to Social Welfare,
    - bring it to the attention of your local TD and even the office of the Ombudsman (if you really want to be difficult)

    The file goes back to Longford and the application continues to be processed.
    You should hear from them within about 4 weeks about a start date for your DA.

    I had appeal allowed letter End of March. So that was about 6 weeks ago. But still waiting. Thanks though.

    It’s possible then if that’s the case that your file has now been sent to your local SW office for consideration by an SW inspector.
    Your application was refused on medical criteria grounds.
    You may still be under consideration regarding the means test and, I have a feeling, HRC.
    Ring DA on Tuesday and ask them what stage your application is at.

    I doubt it's due to means test since I have been on dole over a year. And only have a few grand in bank and no property or assets. I've been searching threads and articles on Google some say it can take 8-12 weeks for payment. So hopefully twill be soon. But if you know anything else about other people's time it will help. Would like to know. Thanks for reply.

    Hi I’m just wondering how long did it take to receive your payment after appeal was allowed mine was allowed 8 weeks ago and haven’t heard anything yet
