Up the Dubs! - is there anything against this nuisance

    Suppose it's a Monday evening. There is no inter county football on and Dublin won't be playing unitl next Sunday or maybe the Sunday after

    You live on an extremely busy road. It's so busy it's difficult to even cross it at times.

    The chap is not shouting, not hassling anyone and just standing outside with his beloved flag many evenings this summer. Every few seconds cars are passing by and beeping the horn leaving a tired resident thinking they are in New York.

    The guy has never given anyone trouble. The issue is the hundreds of passing motorists blowing their horns.

    If you were a garda or a lawyer has the guy found something he cannot be touched for? I mean he's not the one making noise here. I'm just asking hypothetically here and pondering out loud. It's not like I'm going to start taking down reg plates and sueing.

    Before you say go out and talk to him I will at 9pm sharp and he's had his fun. I'm here asking a hypothetical legal question :)

    if freedom of expression allows Ger Brennan to talk about how he doesnt want gay people to get married it also allows a bit of the old flag waving.

    Of course, all responsible motorits know that a carn horn is to be used to alert other road users to your presence when they appear not to notice you and for no other reason.

    The only regulation that I'm aware of covering the use of a car horn is the one which says that you cannot sound it in a built-up area between the hours of 11:30 p.m. and 7 a.m., except in an emergency. Outside of those hours, you could drive around the city all day honking your car horn and there isn't much anyone could do about it, provided you keep moving and don't persistently annoy the residents of a particular street or neighbourhood who might get the council to do something about it.

    Your problem is that, as you recognise, the guy with the flag isn't making the noise. There isn't anything you can do about it.
