Small Claims Court - Initiating Documents Served

    Hi All, i've a quick question re a SCC procedure i've recently lodged online. I submitted a claim a short while ago, and within a few weeks the claim was approved and issued. A few days later the claim was updated and said 'Initiating Documents Served'.

    My question is, who are these documents served to? I presumed the Respondent, to notify them that i've opened a case against them? If so, it was my understanding that they had 15 days to respond, from Consumer Help "The Registrar will inform the business about your claim. The business must then reply within 15 days, otherwise the claim will be automatically treated as undisputed."

    My issue is that this was 80 days ago now, and nothing has changed since! I was going to contact the courts, but then thought that my understanding of 'Initiating Documents Served' was incorrect, and that the Courts haven't been in contact with the Respondent yet?

    Any clarification is greatly appreciated, else i'll just get in touch with the Courts service.

    This is a request for legal advice, which is not allowed on this site.

    However, I would agree that you should make contact with the relevant staff in the Courts Service.

    Cheers, i'm not sure it is looking for legal advice though? Merely clarification over who the documents were served to, e.g. the Respondent or maybe a Court Clerk etc. Was hoping someone might have gone through the process before that could clarify.

    In any case, i've contacted the Courts now, but i'm not expecting a response any time soon!

    Just an update on this in case anyone comes across it. The papers we served to the Respondent. My case had just become stagnant for a few months. Once I got in touch with the courts, they pushed it along and got it resolved.
