Shop is closing - do I get holiday pay?

    Hiya, I've been working here 3 years and next week the shop will be closing down. I haven't taken any holidays this year so far, am I entitled to my holiday pay even though the shop is closing?

    If so, I work part time for minimum wage and so far this year (jan- jun) I've worked 340 hours - how would I calculate this?

    you should be entitled to it. Afaik it's 8% of your hours worked

    you are entitled to redundancy and holiday pay
    whats your average pay per week for the last 13 weeks ?
    you are entitled to 3 weeks of that + 27 hours
    it works out at 66 hours (i think)

    being entitled to and getting are two different things : do you know if the shop is owned by a company or a sole trader?

    Sole trader and its even worse cos we're kind of related. He's never given me holiday pay before but I need it now for the time between jobs! I'm not looking to squeeze him for cash I just want what I'm legally entitled to

    A few years ago, I was working for a company which closed all of a slap owing us wages, holiday pay and redundancy money. It was a limited company and closed with huge debts so no way were we getting it from the owners. We eventually got everything due paid through the state. The wages and holiday pay came quite quickly but it took a while for the redundancy. I'm not sure what the process was as the accountant looked after it all for us. You should be able to do the same thing but how you go about it I don't know. Ask citizens information. The state will be able to chase him for the money they pay you but it will be their fight, not yours, and if he's been acting the bollix not paying you holiday pay for three years I wouldn't feel in the least bit sorry for him when the state comes knocking. By not paying you holiday pay he's effectively stolen your money from you.
