landlord gave my details to irish water,I moved out 6 months ago

    Hi everyone

    Not sure if this is the right place so mods please move if needed

    I just got a phone call from a friend of mine who moved into an apartment that I used to rent 6 months ago,he told me there was two letters there for me from irish water advising that the landlord gave my details as a tenant there and the other was a bill.

    I moved out of this address's 6 months ago and the landlord knows this,also.to note this wasn't a house share I was renting the apartment and my friend took over renting proprty when i left.

    Where do I go from here,I'm going to call the landlord in the morning and see what's up but has this happens to anyone before? Should I call.irish water and let them know? I live with my girlfriend who has already signed up

    Also can my name be given under data protection laws? (Not sure of that can be answer) but if not can someone provide Mr with links to somewhere where I can find the answer myself?

    It is possible that your landlord registered you mid last year when the first registrations came out. The bills and letters only were sent out this year.

    With knowing Irish Water, it is possible that they just never updated the system.

    Contact Irish Water, tell them you haven't resided there since whenever, and take it from there.

    The landlord can give your details, (name and address) to irish water.

    I did this with my tenants last year after checking with ODPC. there was a long delay between me providing the information and IW sending registration packs to the tenants. This could be what happened.

    If your friend is now the leaseholder, shouldn't he/she have taken over responsibility for the utilities when they moved in? Same as electricity/gas etc?

    If the OP left before the charges started, he owes nothing. So he could just ignore IW altogether. Lots of people are living in their homes and not paying. See how they pan out, before telling IW you didn't live there.

    The OP could also look up the out of hours call out fee IW charge, and tell IW he has no liability to the charge and submit an invoice for the same amount for consultancy services.

    Regarding the subsequent tenant, if there was no charging when hte tenancy switched, there was nothing to switch

    Yes, but ought the original householder have known about the landlord's actions and, if so, should the original householder have taken steps to correct IW's records, even in the absence of any written communication from the utility company?

    Wel I'm no fan of bill-dodgers but I am skeptical.

    if you're friend's happy with it just fill in the contact form on the website and say the bill's in the wrong name and give your friend's name. They're normally quick to respond, something similar happened to me this week and they had it sorted in a day. If your friend isn't happy with you giving their name just say you haven't lived there during the billing period.

    You might not want to engage with them for whatever reason but it's the most hassle free thing to do for everyone.

    If you left mid contract and reassigned the lease to your friend, is it not your responsibility as the lease holder to ensure all utilities are also reassigned?
