Injury benefit question?

    Hi everyone,

    I have a quick question about 'Occupational Injury Benefit' and was wondering if anyone could help me out? The question is, basically, can you draw it when you are unemployed, but are incapacitated at the fault of your last employer?

    The full story:

    So I started working last November in my first job (full time), it had already been decided that I would be leaving near the end of May (so a period of work of about six months). At the start of May there was an accident in work, proper safety precautions were not observed by other staff and proper safety equipment not available, and I was involved in a freak accident as a result of which my back was severely damaged - (I am still undergoing exams and analysis but doctors believe I have at least two fractured vertebra in my spine. Muscle damage, and a damaged right shoulder blade).

    I was given medical certs by my doctor and sent them away to claim Injury Benefit on the 12th of May, and received word back this morning that I have been granted 'Occupational Injury Benefit'

    My question is:

    As my term of employment has since ended(to my mutual agreement some time ago - leaving me unable to draw Social Welfare), and I am for all intents and purposes now unemployed; am I actually even entitled to 'Occupational Injury Benefit'? Am I only entitled to it for the few weeks of work left before my contract was ended by mutual agreement? I went to my own S.W office after I had been given the certs by my doctor and explained to them that I was pretty much finished in work anyway at the time of the accident and only had a few weeks of employment left. They said they honestly didn't have a clue how being unemployed would have an effect one way or another on my claim, and told me to just keep sending away my certs and let them worry about it in Dublin. I am wondering, do I have to inform them in Dublin that I am now unemployed (as I received my p45 last week).

    Any advice is greatly appreciated.
