Substandard second hand car sale

    I was wondering can anyone recommend an option I could take as I was sold a second hand car and it has broken down leaving us with a big bill to repair it and I firmly believe the garage that sold it to us has fobbed us off and doesn't care to help us.
    Is there a solicitor around who specialises in small claims involving non road worthy vehicles.

    How old was the car and did you get any warranty? Also when did you buy it?

    02 and a week warranty believe it or not. NCT passed. But I'm suspicious about that. Bought two months ago.

    We had it two months and the gears were difficult to select and they brought it to NCT so they would of known this. Clutch or gearbox is the problem.

    Clutches are generally not covered under warranties iirc

    Two months is enough time for something to fail after they sold it

    If the gears were difficult to select when you bought it, why did you buy it?

    I don't think you've much of a leg to stand on here

    I get what your saying but should they not stand over what they sell?
    I read up on the brand of car and they all gave gearbox trouble. We were in a position where we had to buy this car asap.

    Suppose it's a lesson learned.

    Rhetorical question:When you had an expert look over the car when you were buying it, what did they say?

    As for the sale, you bought an old car with a short warranty. Still some time later an issue surfaces and you aren't happy? So exactly at what pint should the dealer jot cover items on an old car?
    Sorry but it's tough.

    I have a van which had a full service in April, passed it's CVT (NCT for vans) with flying colours. Service guys and CVT guys said it was in great nick.

    2 weeks later, the batteries failed and the week after the gearbox failed whilst in the M7 and I had to be towed.

    Its very unfortunate, but older vehicles will have things failing and you simply cannot forsee a gearbox failure as when they go, they go - they don't half go.

    Possibly talk to the garage and see if they will repair it at cost price as a gesture of goodwill and use a reconditioned gearbox (quite normal) - but still expect €500 - €600 (guess as van is costing 1100)

    If you buy a thirteen year old car that has probably been the equivalent of round the planet several times you get it cheep, the reason it's cheep is because unlike a new car that you will pay a lot for you are taking a gamble about the reliability of said very old car.

    To expect a cheep, very old car to have guaranteed reliability is having your cake and eating it.

    You're looking at a car and the guy says it comes with a one week warranty, you really need to be reading the signals!

    have you tried bringing it to a different opel dealer to see if they can properly diagnose the problem? Get them to document the problem and what it will cost them to fix it. Bring it back to the original dealer to look at.

    IMO better off finding a decent indy and getting them to fix it.

    P!ssing into the wind trying to get money back out of the original dealer.

    NTC isn't worth a fup either way, I just got a car through the NTC with a leaking rack & pinion, they spotted it first time and the rightly told me that the whole thing needed replacing , I steam washed the engine and drained the steering fluid, refilled it because it would take a week for the oil to leak out again, the car passed the NTC

    You found a way around their diagnosis,
    It's still got a leak though.

    EXactly, that's what I'm saying, the NTC isn't a reliable indicator of a car's condition, dealers and mechanics know how to pass a car.
