Strobe lights - legality

    See a m/cycle with strobes coming up behind me on the M50, he was fairly motoring but as he got closer the lights were actually white and it wasn't an emergency vehicle but cars moved out of is way thinking it was an emergency vehicle, as he passed he had a red rear strobe going as well - the 'giveaway' if you like was it was a 'cowboy'd' bike and he had a stars/stripes helmet.
    I'd presume the white / red strobes are not illegal per se so would a 'impersonating an emergency vehicle' charge stand up in court, or not :o
