40 sqm extention query

    I looked at a house for a friend that had a flat roof extention built in 1968 to the rear. Planning permission was granted for same. The extention is in very bad condition and would have to be demolished. Can this extention be demolished and a 40sqm extention be constructed under the exempt development rule?

    My initial reaction is yes you can replace like with like with regards to the planning end of things. But, you are now construction a new extension from a Building Control point of view so you would need to comply with the current building regulations for the new floor, walls, roof and anything else contained within.

    Someone better qualified might answer the planning quiery if I'm wrong.

    The extention is sprawly and is almost the length of the original rectangular building. The 40sqm extention would probably be smaller than the existing. He would like the new extention to tee off around the centre of the original house. I read somewhere that you can't demolish a habitable home without permission but you can demolish part of a habitable home to allow for an extension.

    Sounds like a redesign. Planning may be required.
