Returning Van to dealer

    Hi, I'm looking for advice. Nearly 4 weeks ago I bought van off Volkswagen dealer with 1 year or 15k km warranty. After 2k km got problem with the engine, repaired by them on warranty, but looks like it wasn't fully repaired or sometching is still not right. Can I return van back to them as it's not fit for purpose? I'm affraid that this will be start of problems with this van and can't afford it have it in garage instead of road.

    You would need an independent mechanic to do a report on it. contact Consumer Help to see how you go about it. If you are claiming 'not fit for purpose' you will have to show how you havent been able to use it for your business.

    But remember they have the right to fix it first. If you feel it is a lemon, you would need an expert opinion on it.

    Thanks, rang Consumer Help, but because it's commercial and bought for business, I was told I have no protection as private person would.
    Do you think a typical garage would be good, or should I talk to expert like assessor? They are a volkswagen dealer so I would imagine bringing it to another volkswagen dealer be pointless.

    There has to be some form of protection. There was a contract of sale somewhere I'm sure. And that contract was drawn up with respect to some form of legislation. If consumer help cannot 'help', did they at least advise where to direct your issue?

    Do you have a business group that you can contact about this? I would get some legal advise before trying the next part,( just to ensure that you have legal recourse in the event you need to rent something temporarily...)

    I would contact the garage owner/manager directly and explain that you are not happy, and that the van is required for business use. You will give them one more opportunity to address the issues you have, but after that you will take legal action to recover any costs you incur while the van cannot be used in the course of your business.

    Also, check with your insurer ( general business cover, not your motor policy) and see will they cover legal costs if you need to pursue this. Most policies will cover you to some point for legal expenses connected with your business.

    Commercial or not, you should have some rights.

    Go talk to a solicitor, could be the best €50 you spent.

    What is wrong with the van? Have you gone back and said you feel it's not right or have they refused to look at it again? I think you maybe jumping the gun a little otherwise. They maybe able to give you a loan van while yours is in unless it has a fridge in it or something like that.
