contract help - can't work for other companies

    I currently work for a company that does outsourcing to a lot of companies and busnisses around Ireland.

    I recently had a job interview with a company and offered more money and is 60km less of a drive too from my house. Very ideal.

    Unfortunately I realised that this company is actually a client of ours. I have never done any work for this company as its in a different division.

    My contract states that I cannot work for any of our clients for 12 months after leaving the company. Anyone any advice? Need to hand in my notice tomorrow or ring the company I'm meant to be going to and see what they say? Can't sleep over this! It was never mentioned in the interview as its a different division.

    Just hand in your notice, work out the notice period and don't give any details on where it is you'll be starting. Or say you're leaving to take a break for a while... should you be asked after you've left just mention that you got a better offer subsequently.

    TBH, I've seen plenty of co-workers who had similar contract clauses join clients of the business we were working for at the time and none of them were ever persued on it. It'd be a fairly difficult clause to enforce from a legal perspective and, presumably, an expensive one since the ordinary PAYE worker wouldn't have the cash to pay any compensation if they lost the case.

    Unless you are taking intelectual property or company inside information over they cant say much.
    the law wont disallow you from working and earning a living

    don't stress about it. The most I have ever seen done was a legal letter sent to the former employee and with copy to new employer. That didn't change anything. A 12 month non compete is unreasonable in law and is pretty much unenforceable.

    Don't take any IP with you though. That's an entirely different matter.
