Employment Notice periods

    Following on from some discussions in the work problems forum Id like to get some feedback here.

    Scenario 1
    John is employed by ABC ltd, hes there 6 months and has signed a full time contract with a months notice required. The company decide to get rid of him with immediate effect. They are required to pay him his months notice.

    Senario 2

    Same situation except John walks out without notice. Company pay him in arrears.

    Can the company withhold his wages in lieu of notice ? If not what recourse do the company have as John has breached his side of the contract.

    I would have thought the company is obliged to pay him his month's wages.

    Separately, they could take a case against him for breaking his contract.

    I don't think they can hold his salary back pending judgement.
