Question regarding site with planning permission.

    So if you acquure a site with full planning permission on it but you dont like the design of the design of the house in the planning. Do you have to basically start from scratch with the planning to change the design of the house? Also how long does the planning last for??

    To my knowledge yes you do have to re apply for planning again as you would be making material changes to what was originally approved.
    planning takes between 8 to 16 weeks and lasts for 5 years once approved. But some of the lads here will be better able to answer your question.

    Yes you do have to reapply but the advantage is you are far more likely to get the planning approved as it was already approved for a previous design.

    If the changes are very minor you won't have to reapply. For example minor alterations to incorporate new regulations or internal alterations that don't modify the external appearance and don't change use or impact on any regulations.

    Planning permission lasts 5 years from the date it is granted.

    you only apply for "change of house design" permission
    its not consider a whole new application with everything open for deliberation again, only the house plan changes.

    the application however still takes the same amount of statutory time.

    please note you cannot apply to change the design of a house under a permission which has been extended beyond its original 5 years.

    Thanks for that sydthebeat. That is what I didn't want to hear. The planning has been extended beyond its first 5 years sadly so does this mean that it is start from scratch again?

    Also how far does the construction have to be within the period of the planning?
    I have heard before that it only has to be up to the wall plate and other people have told me it has to have the roof on and windows/doors in.

    1. contact your local planning authority to get this clarified. All councils have different interpretations of the regulations, so you may be lucky.

    2. If the house is not complete by the time the permission expires, you will need to apply for permission to complete the development, unless all you have left is internal works.

    "substantially complete" in regard to planning is only application if you want to extend the duration of the permission to complete the build. Seeing as the permission has already been extended, you cannot extend again, and thus 'substantially complete' is meaningless in your context.
