Penalty Points - Moved Home

    Hi Guys, Not sure if anyone can help on this. Basically, story is as follows

    1. I got penalty points notification in November, my partner was driving, sent back the form noting the same.
    2. Received letter stating that they had received my response and that I was no longer involved. This letter was dated 19/12/2014.
    3. We have since moved house on 8/2/2015, nothing received for the penalty points by my partner.
    4. Have asked the letting agent(the house has been sold, but he is looking after that also) on two occasions since as to whether any post, he has dropped a few letters in, but nothing in relation to the penalty points.

    I am not sure as to what to do - should I ask her to contact the penalty points issuing place in Tipperary to ascertain as to whether anything is outstanding, or is it best to leave sleeping dogs lie.

    I am mindful of having an outstanding summons or something like that.

    Any thoughts would be appreciated

    hi Victor when filling out form didnt have licence number to hand. form said it wasnt a requirement just name dob and address so that was what we gave.

    Hi there had to check, the licence address is at her home address (ie her parents address)

    So summons has been issued but to wrong address. An Garda said just turn up in court and show that points notification and subsequent summons for non payment of same issued to wrong address and Judge should throw out. Any truth in this ? Apologies if such question not allowed

    They sometimes don't even show up in court themselves.

    You have legitimate reason, you will be fine.

    Relying on a garda not showing up in court is madness as it is such a long odds gamble over which you have no control over. Even answering a summons using such a defence is a risk a layman ought not to take unaided, especially as it was the address provided at the time.

    Best thing to do is to pop into a solicitor who has experience in district court matters and run it by them.

    No the address was wrong full stop. Right estate wrong number. As the garda said you cant pay a fine you never received
