Phone I sent back to China for a repair still broken.

    A phone I bought from a Chinese company (Etotalk) stopped working.

    The company agreed to repair the phone so I sent it back on the 20th of January, I have received the phone back just today and it is in the exact same condition.

    It is not turning on, or charging (which was the original problem)
    I did not break the phone nor did I spill any liquids on it.

    In addition to not having the phone I have also had to fork out nearly €60 on sending the phone and paying custom charges.

    I really need some advice please.

    If the company is based in China only then, unless you can resolve it with them, you will find it extremely difficult to escalate the matter and complain to some consumer protection body based in China.

    Maybe try and get it fixed here?

    I initially wanted a refund and they refused, and offered me a repair.
    Surely something can be done, can I escalate this into a legal matter?

    I paid $335.94 at the time and that is excluding the €50 - €60 I have forked out on sending this phone for a repair.

    Youve almost no comeback apart from dealing with them directly and trying to get it sorted. Have you tried to see when you plug into into your PC if it is found?

    How did you pay for the phone? Paypal? credit card? you might have some recourse through that

    If you mean credit card chargeback, I don't think that applies where the goods were delivered and then developed a fault. The same probably applies to Paypal, it's effectively a warranty claim which neither the credit card company nor Paypal will figure has anything to do with them.

    Unfortunately if you buy from China, you have zero comeback, that's about all there is to it. I buy small gadgets from Dealextreme but wouldn't dream of spending a few hundred dollars on anything from China, precisely because if something goes wrong, there is no legal remedy and you're not dealing with a company who have a reputation to worry about. They can setup the same operation under a new name the next day, just like the indie motor dealers on the Long Mile Road in Dublin!

    You have no comeback with the supplier.

    You should be able to claim back tax paid (if it was paid twice).

    Its a bit of a longshot i grant you. But i think its the only shot they have.

    I paid by Paypal and they refused to help when I contacted them prior to sending the phone.
    It was outside their time limit for support.
