Insurance question :)

    Hi, I was involved in a small car accident recently. It was not my fault and although the other party denied it his insurance agreed to pay with no contest due to the witnesses.

    My question however is, the insurance company have given him my phone number and he keeps ringing and harassing me to settle outside of insurance. Can they release this information? I was avoiding all direct contact with him on purpose as he was very aggressive at the scene.

    Any advice would be great before I pursue it further.

    Some options:

    1. Tell him to fcuk off and block his number.
    2. Go the guards if he doesn't.
    3. Hand it over to a solicitor if you need to do so. In fact, you could do that now if you want, since legal costs are often paid if liability is not an issue, after issue of proceedings. You can check the costs position with the solicitor.

    I can deal with him, that's not the issue. I was more asking about the fact the insurance company gave him my details without my permission, is that not a breach of data protection?

    I don't think that the Financial Services Ombudsman can deal with complaints against third party insurers, but you could report it to the Data Protection Commissioner. There is no compensation but I don't think that is your motivation anyway.

    Can't you just accept his offer of a cash settlement, won't that get him off your back?

    Tell him to show up with the cash by a given date or else you'll take the cheque the insurance company is offering.

    I understand the issue about data protection but I can also see the issue from the other guy's point of view - he wants to protect his NCB by paying you off so it's not surprising that he's anxious to settle and maybe coming across a bit strong about it.

    He was aggressive at the scene, denied it but his company paid out on witness statements, now he's making harassing phone calls.
    Not a chance the op should engage with him.
