Help with legal discussion

    Hi all,

I have been given an assignment as part of my course, which involves identifying an area of copyright law in Ireland that should be changed and giving reasons for it. Basically, my discussion would centre around how the current legislation governing online file sharing (and its case law) is insufficient. I was thinking of taking the angle of discussing online file sharing and section 37 CRRA. Is this a sufficient angle? Are there any other points to discuss on this matter? Or are there other areas of copyright law that are riddled with issues?

    Many thanks!

    Step 1. Go to Library

    Step 2. Open Copyright Books

    Step 3. Read

    Step 4. Identify Case Law

    Step 5. Read Case Law

Step 6. Form Opinion on Case Law

Step 7. Write Opinion on Case Law

    Step 8- Repeat

I think that where the laws concerning filesharing become somewhat interesting is in relation to their enforcement but if you start talking about 'three strikes' rules versus rights to access to the Internet and the French HADOPI law then you may have meandered off course from the ambit of s.37 of the CRRA.

What's the general thrust of your intended discussion?

Well the main thrust was to discuss how digitisation presents a lot of challenges to copyright law, with regards to file sharing online and ISP liability. This may cover quite a large area of copyright law but I'm trying to narrow it down and get a solid angle, as the question is extremely open-ended.

You could research the position concerning response to P2P filesharing in Ireland and other countries, show how Ireland measures up overall, and round off with your recommendations concerning reform. http://en.wikipedia.org/wiki/Graduated_response
