retention issues on old house

    Hello,
    My aunt recently went for retention for her house (wants to sell it and move closer to town). She got a letter back from Clare County Council telling her that she needs to do an assessment of the ground and the septic tanks ability to take the loads, and if not, then she must get a proposal for a new system installed. She has no intention of installing a new treatment unit to get retention for a house she will sell soon. Is the planning authority being fair here? Shes lived there for over 40 years with no problems, and all of a sudden they are asking her to give proposals of preventing water running onto road, sightlines, etc. Or does she just do what the planners want (reports etc) to get the retention over the line, and then forget about it?

    "All of a sudden" she wants to sell.
    The planners are treating her like anyone else.
    If she does not want to do anything she does not have to.

    yes the planning authority is being fair

    she can only be applying for retention if something unauthorised was done, so its not unfair to apply modern standards now.

    all she needs to do is get the information together, get the permission, and sell with full disclosure to the buyers of what has to be done to comply with planning permission.
