Personal Injury Claim Against Me

    OK, So had an accident a couple of months ago my car cost too much to fix, and there was minimum damage to the other driver's car. No one was injured(there was passengers in the other car no injuries) i just went to hospital to get everything checked. I spoke to the driver on the day & accepted it was my fault and told him to send me the bill when his car is fixed. I filled out an accident report form then a couple of weeks later the driver texts me to say the car won't cost much but it's old and NCT is up soon so he's going to write it off and go through insurance. I haven't heard anything since then only that there is a delay with possible personal injuries of the passengers in the car.

    This has been going on since October so i've no idea what's happening what should i do?
    I was only working part time back then. I haven't worked since but i've saved enough to buy another car now so i don't know, will they still insure me? or will it be more expensive?

    Has anyone been in this position before? obviously i've never had an accident before.

    Unclear what you mean, you asked them to send you the bill buy they decided to go through your insurance? Did they go through your insurance, did you pay the damage?

    Driver & i agreed not to go through insurance initally & that i would pay for the damage to his car. I haven't heard anything from my insurance just received the 'accident report form' so no haven't paid anything

    It can take i months in some cases years for a personal injury claim to be completed.

    In some cases you may be lucky that the other party has just not gotten around to filling in all the forms and sorting it with your insurer.

    In some cases the other party is in fact holding out to insure the injuries they have are not actually lasting ( a minor crash can actually cause relatively permanent injuries)

    In other cases the other party chooses not to engage with your insurer at all and has taken the services of an injuries solicitor in order to take it to the PIB or court.

    No one here can really tell which one of the above it is, you would need to speak to your insurer.

    I believe it took my sister nearly 18 months if i recall with a taxi driver who would no settle.

    My fear is court. I just wanted to deal with the whole thing & got it sorted asap. I don't have a car but If i buy a one now am i staying with my insurance company i thought they may not want to insure me

    You shouldnt be worried about going to court.
    Did you notify your insurance company withing 7 days, they get a big ancy if you didn't.

    Chances are though your insurance company are playing the legal route on this one and you're out of the loop.

    Personal injuries cases can drag on awful. I had an accident in 2009 and my case is still ongoing, I'm hoping it will end this year. I know the other driver/company aren't involved any more, its just an insurance company rep, their solicitor and a barrister. But it was clearly their customers fault and they have accepted full liability.

    Chances are yes, your insurance will indeed be increased, definitely while the case is outstanding and depending on the outcome how much its affected afterwards.
