Trademark Maybe Copyright, Something else ??

    I am part of a Association founded many years ago and like many clubs and Associations the committee of the time created a logo to be used on tops/fleeces and patches these items then where sold to members etc, money made from these items went back into the Associations kitty.
    The person who designed this logo after many years of use has recently fell out with the Association and now wants the logo paid for or that the Association stops using it.
    My question is can he demand we stop using it ? as paying is not a option.

    Would a nice middle ground be to stop using the logo going forward, but that anything already bearing the logo is okay?

    I don't really think you need legal advice, as these kinda things rarely go to court or anything. I'd say it'll fizzle out. Give him a few days to calm and ye'll most likely all be friends again?

    If he designed it he owns the rights to it. What original agreement was there if any? You say the Committee created it so did he actually design it? What is the problem with paying for it btw?

    The lad that designed it was part of the committee that created the logo wrote rule books etc.. And now that he is gone from the association on bad terms he is kicking up and demanding we stop using the logo or buy it at a price that's not reasonable.

    If he created it as a member for the association there is an argument it belongs to the association.

    Tell him to f off and get a solicitor.

    If he does, get one yourself. Otherwise dont engage.

    I'm just thinking that he may have, since the falling out, registered the logo as his.
