PLANNING ADVICE FOR SIDE OF HOUSE

    Hi,

    I am looking for some advice regarding the planning laws for building on to the side of a house. I am in Fingal area.

    Basically we are looking to build on approx. 14 sq meters to the side of the house. This will be a lean to. It is to be used as a shed but we want it finished off to the same standard as the house.

    We are within the requirements for no planning permission based on:-
    - It will be used as a shed
    - The floor area will be <25 sq mtrs
    - The height will be <3mtrs
    - There will be >25sq mtrs left in the back garden

    The question I am unable to get an answer to is:-
    The lean to will consist of 3 walls, obviously. The long wall (21ft) will be built just inside the current boundary wall. The problem I have is this will end up slightly higher than the boundary wall. I know if we used the boundary wall as our shed wall we would need to higher it and therefore would need planning permission but the fact we are not touching the boundary wall but will have a wall that is slightly higher than it running along side....does that require planning permission?

    Can anyone help!?

    That's what I thought initially but here is what is quoted on Fingal's site.....


    7. Can I build a garage?
    You can build a garage, carport, shed, greenhouse, kennel
    for domestic pets etc., as long as it does not extend out in
    front of the building line of the house and does not exceed 4
    metres in height, (if it has a tiled or slated pitched roof), or 3
    metres (if it has any other roof type). The floor area
    limitation for exempted development is 25 square metres.
    The structure may not be lived in, used for commercial
    purposes or for keeping pigs, poultry, pigeons, ponies or
    horses. Garages, sheds etc. to the side of the house must
    match the finish of the house. You cannot reduce the open
    private space, reserved exclusively for the use of the
    occupants of the house, at the side or rear of the house
    below 25 square metres.

    So as I said I fall within all these conditions but the height of the wall:boundary wall is not mentioned.

    AFAIK the shed/garage referred to here would be detached from the main house.

    The missing word here is attached. So you can not extend or appear to extend to the side.
