    Edited this post and my original question didn't save. I'm new to forum so did something wrong I think. My situation is, I was unfairly dismissed in 2012 (case was in rights commissioners and they found it to be unfair). The circumstances are fairly unique so unsure as to how much detail to provide here. In the RC recommendations, it stated "I find that this dismissal lacked any form of fair play and natural justice....... must conclude that the dismissal was both substantively and procedurally unfair."
    I'm unsure as to what/ how much to tell a prospective employer, any advice would be greatly appreciated.

    If you're not at fault and obviously you weren't I'd tell them the truth otherwise if they find out themselves later they will think you have something to hide.

    Has it taken you 3 years to find another job. Have you gained any new experience since this position was terminated. Hope you received some compensation, for this dismissal, not that it will ease the pain, if it has forced you into long-term unemployment.

    Yeah it has, I got some interviews but no paid work since. I did some volunteer work with a charity though.I got compensation which I used to pay for a few courses (in the hopes it would improve chance of getting a job). For me, the money helped, of course it did, but justice was much more important. Very traumatic experience, especially the reason why, but I wanted that piece of paper to say what they did was wrong.

    Make an unverifiable lie to cover up the gap - sick granny etc. Don't mention the unfair dismissal. If the previous employer is required as a reference hope they don't try and screw you, generally they won't it's more hassle than it's worth.

    Alternatively come clean*, hope they're a professional outfit that realises these things happen from time to time.

    *not that you've anything to 'come clean' about.

    Do not come clean….sorry but that's just not good advice. Most employers/HR people will run a mile from you if you do. You'll be tarred as "trouble" as "there's no smoke without fire". Employers who see employees take their former employers to court will think (rightly or wrongly) you're highly litigious and will look to pursue a case against them if everything is not 100% perfect all the time. DO NOT DO THIS.

    Meh I'm being lambasted in another thread so I hedged. Yeah likelihood of the honest approach working are about as good as winning the lotto.

    Pick your battles, avoid a company that do extensive background checks. Depending on what you're looking for maybe a mate can get you in somewhere.

    I agree with the above on this. Although you won your case there is no guarantee that this will hold water with another employer.

    If it was me I'd be saying I was working abroad or something for the last 3 years.
