Development levies for change of use planning permission

    I have just managed to get a planning application successfully granted for a customer. Its a change of use from commercial to domestic use-it was a creche. The only alterations will be adding a new kitchen and knocking down a wall internally, otherwise the building will be unchanged. The council concerned are looking for €12,000 in development levies! This seems a bit ridiculous to me so am asking is there any way to appeal these levies or avoid them?

    A new house has been 'created', so, I'm pretty sure the LA have applied the applicable levies for a new house.

    If the LA has applied levies in accordance with their own policy/development plan then there is (very) little hope on appeal.

    I don't think so as all works will be internal-it already has its heating system in place. The works for the kitchen ill simply be an upgrade-not a whole new kitchen and the wall being taken down is also internal. The PP was for change of use not a new building. Nothing will change externally. It seems rather sharp practice to charge development levies!

    a material change of use is covered in the regs, and assuming the creche is probably 10ish years old, there may be significant alterations required.
