Obtaining video footage of attempted bike theft?

    During the month of May 2014, I foiled an attempt to steal my bicycle from outside a business in Dublin. I restrained the perpetrator who was arrested, and with the help of the businesses CCTV footage, was convicted to 6 months in prison.

    In May I requested a copy of the footage from the business, however I was told that it was against their policy to supply footage to anyone except the Gardai.

    I repeatedly requested a copy of the footage from the Gardai but was repeatedly given different excuses for why they were unable to advise/assist me.

    I think it's safe to say that the business has deleted the footage by now, but can anyone advise if there are any circumstances under which I would be able to acquire the footage from the Gardai?

    Why would you need it? Other than a civil suit (let the lawyers handle it).

    If it's your intention to publish it, which would be my and probably anyone else's reasonable assumption I doubt you're going to be let have it.

    Don't be a pest, it will discourage people from releasing footage even to the guards.

    You haven't given any reason for wanting a copy so it's impossible to say whether you could ever be entitled to one.

    What I will say is that I cannot see from your post any reason why you could get a copy.

    The only reason I can think of is you want to show your mates.

    The shop could give you a copy but it their footage and they don't have to.

    The Gardai also don't have to give you it either.

    However if the thief accuses you of assault and you are charged you would be entitled to a copy of all evidence against you.

    "6.3 What if I am asked for a copy of CCTV footage?


    Any person whose image is recorded on a CCTV system has a right to seek and be supplied with a copy of their own personal data from the footage. To exercise that right, a person must make an application in writing. The data controller may charge up to €6.35 for responding to such a request and must respond within 40 days."

    Unfortunately I only discovered this after the 40 days period.

    Good news for you. ..actually means they have 40 days to respond...not you have 40 days,however it depends how long you wait, some companies only keep data for a year,for internal security and CCTV I haven't a clue how long they keep it

    I stand corrected, , thats some stupid ass legislation with no thought behind it.
    Does it have an enforcement option, who to call if they dont like?

    It also says :

    Where images of parties other than the requesting data subject appear on the CCTV footage the onus lies on the data controller to pixilate or otherwise redact or darken out the images of those other parties before supplying a copy of the footage or stills from the footage to the requestor.

    The shop may not want to go to the expense of doing this.

    It may also make the footage unwatchable from your point of view.

    The shop has no choice, it is a breach of the Data Protection Acts. There is even an example case published by the DP were a wallet was stolen and the company refused to give a copy of the recording to the owner.

    When is the money (including lost growth) Michael Noonan took in the Pension Levy going to be paid back?

    But is is it not true that even if the shop give the OP the cctv they are allowed to blur out anyone except the OP?
