newspaper used my photo

    Yes another one of these posts but not quite.

    I took a photo of the cruise ship The World back in 2013 when it was in Galway bay. It's been on flickr since and marked as all rights reserved.

    The paper didn't print my photo in one of their issues but they were commissioned to publish a press release and info magazine about the plans for the new Galway harbour. That is what my photo is printed in.

    I was never asked nor was I credited. Could I ask for payment for using my photo?

    I'm not aloud to link the photo but it has all the meta data from the camera attached so can test prove that I took the original?

    Invoice for the the image and add extra for unauthorised use.

    Thanks. I've seen people mention rate cards in other posts to check how much to invoice them but the only thing I can find is the rates to place an add on their paper

    In this case the rates are what YOU want to charge them. They have agreed in advance to what you charge by stealing your image. What they have done is illegal but, unfortunately, nobody seems to pursue them for this. They will have rates which they offer to pay for images, you then have the choice to accept this or not. In this case they have just taken your image and so it's up to you what that image is worth to you.

    Keep in mind that the vast majority of images that they lift like this will never be discovered and so they will pay nothing for them. That is why they do it. Imagine if you operated a Used Car Lot and just went around the streets stealing cars to sell on your lot and only 5% of the owners ever discovered it and then the only penalty was to pay for the cars where they were found out. You would have a huge advantage over your competitors who operated legitimately. Soon the only businesses surviving would be those who stole cars.

    this kind of thing happens so often on places like Facebook ..
    people take photos use them else where or even just portray them as their own to get some business from them ... i hope you did invoice them and got sorted would love to hear the outcome
